Terms of Use
The User Terms ("the Terms") apply to all websites located and linked to the domain https://www.aipoint.com.tw/en/terms-of-use/ ("AIpoint," "we," "our"), property of AI point AI & Environment Co., Ltd. ("AIpoint Company").
1. Acceptance of Terms
These Terms apply to all members or visitors ("users," "you") linked to Wolong Intelligent Environment, regardless of their physical location. By continuing to use the services provided by AIpoint, you acknowledge and agree to these Terms. If you disagree with any part of these Terms, you should immediately cease using AIpoint. Please also read our Privacy Policy before using AIpoint.
If you have any questions, feel free to contact our customer service at any time. Rights and obligations of course proposers will be separately established in the fundraising course contracts.
Users under the age of seven are not allowed to create accounts on AIpoint and must have their legal guardians create accounts for them. Users who are over seven but under twenty years of age must have their legal guardians' consent before registering as members and using the member services provided by AIpoint. Users under twenty must ensure they have their legal guardians' consent to use the services provided by AIpoint. By applying to register as a member and continuing to use the services provided by AIpoint, it is deemed that their legal guardians have read, acknowledged, and agreed to these Terms.
* Terms Update *
AIpoint Company reserves the right, within the scope allowed by law, to modify or adjust any content of these Terms at any time. Should there be any modifications or adjustments to these Terms, AIpoint will announce such changes. Any modifications or adjustments become effective upon announcement. If users continue to use the services provided by AIpoint after such modifications, it implies agreement to the changes in these Terms. Therefore, users should regularly review these Terms to ensure they are aware of all changes. If users disagree with the changes to these Terms, please leave the AIpoint website and immediately cease using AIpoint services. In addition, members should delete their personal profiles and cancel their memberships. AIpoint Company also reserves the right to delete member profiles and cancel memberships in cases of violation.
2. Account and Password Security
Both visitors and members can browse content on AIpoint, but only registered members can purchase online products and enjoy various services provided by AIpoint. Visitors can easily create an account on AIpoint by entering an Email or logging in with their personal Google or Facebook accounts. Upon creating an account, members should provide and continuously ensure the authenticity and completeness of all personal information related to the account creation. All personal information is considered essential for registration. If the personal information provided at the time of account creation is found to be false, untrue, or incomplete, it will be considered a violation of these Terms, and AIpoint has the right to stop providing services to that user. Any disputes arising from providing false or incomplete personal information are unrelated to AIpoint, and AIpoint is not responsible for them.
Users should not use any information unrelated to their real personal data to create their account names, including but not limited to using names that imitate others, offensive words, any racially discriminatory text, and any text that could harm or infringe on others' rights as their account names. In such cases, AIpoint reserves the right to terminate the service for that account. Members should properly keep their accounts and passwords and should not transfer or lend them to others for use. If a member discovers their account is being used illegally by others, they should immediately notify AIpoint. AIpoint is not responsible for any unauthorized use of accounts or passwords due to hacking activities or negligence on the part of the member.
You are obligated to safeguard your account, password, and other related identity verification information and are responsible for all activities and actions conducted under your account after logging into the system, including but not limited to related costs.
You agree to follow all applicable laws when using AIpoint and to use the service only for lawful purposes. Using the service or accessing the system in any way not agreed upon or instructed by AIpoint is strictly prohibited, and AIpoint reserves the right to stop providing service to such users.
3. Privacy Policy
The personal information provided by users and certain other information related to users saved by AIpoint Company will be governed by the laws of the Republic of China and AIpoint's Privacy Policy.
4. Usage Regulations and Agreements
Content purchased by members on AIpoint is for the exclusive use of the purchasing member within the agreed period and is strictly prohibited from being shared or made public. If a member violates this agreement, AIpoint reserves the right to cease providing services to the user upon discovery and to sue for damages caused by the infringement, demanding punitive damages of 1500 times the course's unit price.
All content uploaded, posted, emailed, or otherwise transmitted through AIpoint services, whether publicly or privately, is the responsibility of the content provider. AIpoint bears no responsibility for any unauthorized content uploaded by members.
AIpoint cannot guarantee the legality, accuracy, completeness, or quality of the content transmitted through its services. Users may be exposed to content uploaded by members that is accused of infringement by third parties, or content that is unpleasant, inappropriate, or offensive. AIpoint is not responsible for any such content but reserves the right to immediately halt the transmission of any such content and take appropriate actions, including but not limited to suspending the member's access to the services in whole or in part, preserving relevant records, and taking legal action. Users must comply with the laws and regulations of the Republic of China when using AIpoint services and agree not to engage in any illegal or improper activities.
Users are prohibited from downloading, reproducing, publicly transmitting, reselling, publicly broadcasting, sharing, or using any products or content from AIpoint. Users who violate this provision will bear all legal liabilities arising from such infringement.
5. Invoice Issuance
AIpoint will issue and send an invoice to the purchaser after the purchase of products (whether pre-order or regular items). However, if the course is purchased outside of Taiwan, it may be exempt from issuing invoices according to the tax laws of the Republic of China.
6. Third-Party Links
AIpoint may contain links to third-party websites outside of AIpoint. Since AIpoint cannot control these websites and resources, users should familiarize themselves with the terms of use and privacy policies of these third-party websites before use. AIpoint is not responsible for any direct or indirect damages or losses arising from any content, goods, or services obtained from third-party websites or resources, and AIpoint does not endorse or guarantee these third-party websites or resources.
7. Intellectual Property Rights
AIpoint owns all rights, ownership, and interests, including all copyrights, patents, trade secrets, trademarks, and other intellectual property rights, in all content published on AIpoint ("Site Content"). All rights not expressly granted are reserved by AIpoint.
The design or layout of AIpoint is protected by copyright, design patents, trademarks, unfair competition laws, and other laws and may not be copied or imitated in whole or in part. Reproduction or transmission of AIpoint's trademarks, design, sound, or images without explicit authorization from AIpoint is prohibited.
8. Content and Other Legal Rights
AIpoint Company does not own all the content uploaded to AIpoint. However, when a member publishes, uploads, or submits content to AIpoint, the member agrees to grant AIpoint Company a worldwide, irrevocable, non-exclusive, royalty-free license to reproduce, use, publish, translate, display publicly, transmit, broadcast, and create derivative works from such content on all current or future media platforms. The member agrees that such use shall not require any compensation.
9. Termination of Service
Users agree that AIpoint Company has the right to terminate or suspend a member's access to AIpoint services at any time, for any reason, including but not limited to infrequent use of the services by the member or violation of these Terms. AIpoint Company may delete the member's account and content upon termination of service without notice and prevent the user from linking to or using AIpoint in the future.
10. Indemnification
Users guarantee that AIpoint Company and its management, directors, employees, agents, and contractors will not suffer any losses, liabilities, damages, or expenses (including but not limited to reasonable attorney fees) arising from: a) content published or submitted by the user; b) use of AIpoint; c) violation of these Terms by the user; d) infringement of any third party's rights by the user. Users agree to indemnify for such claims and demands.
11. Modification of Service
AIpoint reserves the right to temporarily or permanently terminate the service (or any part thereof) at any time, within the limits of the law, with or without notice. Users agree to back up their data regularly to prevent data loss, and AIpoint is not responsible for any content loss or related losses suffered by users.
12. Transactions with Advertisers
Users understand that all advertising content, marketing text, and product descriptions placed on AIpoint are published by the respective advertisers, product, and service providers. AIpoint only undertakes to publish such content and does not substantively review or modify it. Users should carefully evaluate the accuracy and reliability of such advertisements. AIpoint is not responsible for any losses or damages arising from transactions related to these advertisements, except as explicitly required by law.
13. Prohibition of Commercial Activities
Users agree not to: a) modify, reproduce, reverse engineer, disassemble, or attempt to obtain the original code or content for any feature or program while using AIpoint; b) upload content that includes any commercial or embedded marketing content. AIpoint reserves the right to unconditionally remove or take down content that violates these regulations.
14. Warranties and Guarantees
AIpoint does not guarantee that: a) the service will meet the specific requirements of the user; b) the service will be uninterrupted, timely, secure, or error-free; c) the results obtained from using the service will be accurate or reliable. Any products, services, information, or other materials purchased or obtained through AIpoint may not meet the user's expectations, and d) any errors in AIpoint will be corrected. The decision to download or obtain any materials through the service is at the user's discretion and risk. Any advice or information obtained by the user from AIpoint or through the service, whether written or oral, will not provide any warranties not expressly stated in these terms.
15. Limitation of Liability
Users acknowledge and agree that there are inherent risks in using AIpoint, and to the maximum extent permitted by law, AIpoint is not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from: a) the use or inability to use AIpoint's services; b) the cost of procuring substitute goods or services resulting from any goods, data, information, or services purchased or obtained through AIpoint; c) unauthorized access to or alteration of user transmissions or data; d) statements or conduct of any third party on the service; e) or any other matter related to AIpoint's services not governed by these terms, even if AIpoint has been advised of the possibility of such damages.
16. General Terms
These terms and the relationship between the user and AIpoint are governed by the laws of the Republic of China. Any disputes arising from the service, these terms, or other related matters will be subject to the exclusive jurisdiction of the Taichung District Court in Taiwan as the court of the first instance. If any provision of these terms is found to be invalid due to conflict with the laws of the Republic of China, the remaining provisions of these terms will remain in full force and effect. The headings in these terms are for convenience only and have no legal or contractual effect.
